HCSO NEWS RELEASE:
“Rene Anthony Garcia, 46, of Gainesville, was arrested this week following the seizure of illegal narcotics at his residence in southeastern Hall County.
On Tuesday…the Hall County Sheriff’s Office (HCSO) Special Investigations Unit (SIU) and a K9 team assisted the Hall County Probation Office with a Fourth Amendment Waiver search of Garcia’s residence on Bob Bryant Road. Law enforcement located twelve (12) THC cartridges and thirteen (13) grams of marijuana in a back room of the house. The street value of the illegal narcotics was estimated at $1,040.
Garcia was taken into custody at the scene on charges of possession of THC oil with intent to distribute, possession of marijuana with intent to distribute and probation violation.
He remains in the Hall County Jail with no bond.”
What does it mean? A Fourth Amendment Waiver search? According to the Justice Department’s Office of Justice Programs, it means “These searches are often based on the theory that a parolee or a probationer has consented in advance to waiving his or her constitutional rights to be free from searches and seizures without a warrant and without probable cause.”
