Investigators say the victim was attacked with a baseball bat, stripped of his clothing and shot at by one of the suspects.

HALL CO. SHERIFF’S OFFICE NARRATIVE:

“Hall County Sheriff’s Office (HCSO) deputies have arrested two men in connection with the Friday night, Oct. 27, armed robbery of a man at a residence in Gainesville.

Deputies took Joshua Gutierrez, 17, of Gainesville, into custody on Saturday night, Oct. 28, in the 700 block of Ga. 60/Queen City Parkway. They arrested Andre Marcus Brooks, 17, of Flowery Branch, on Monday morning, Oct. 30, in the 2700 block of Tumbling Creek Road. Deputies previously obtained arrest warrants charging each individual with one count each of armed robbery and aggravated assault, both felonies, and misdemeanor battery.

According to the initial investigation, Gutierrez, Brooks and a third male suspect picked up the male victim, 16, from a store on Shallowford Road. They drove the victim to a residence in the 1200 block of Bradford Street Extension on Friday night, under the guise of going to a party. The victim, Gutierrez and Brooks knew one another.

While at the residence, the suspects assaulted the victim with a baseball bat, stripped him of his clothing and fired a gunshot in the direction of the victim. They took items from the victim and left in a vehicle.

Hall County Fire Rescue transported the victim to the hospital for treatment. He has since been released.

HCSO Investigators continue to seek the third suspect in the crime. Gutierrez and Brooks remained in the Hall County Jail without bond on Monday afternoon, Oct. 30.”
