GSP: DUI driver facing several child-related traffic charges, tried to avoid DUI charge

A 27-year-old Gainesville man was still in the Hall County Jail at mid-morning Saturday after being arrested Thursday on DUI and several child-related traffic charges. In addition, he and a passenger changed seats after the accident to make it appear he was not the driver, according to the state patrol. And there’s also an immigration “hold” on him.’

STATE PATROL NARRATIVE:

“On (Thursday about 1:00 p.m.), a trooper from the Gainesville Post of the Georgia State Patrol was dispatched to a traffic crash that occurred at the intersection of Cross St and Memorial Park Dr.

The investigating trooper determined that the driver of a 2004 Red Honda CR-V failed to yield at the stop sign and was struck by a 2017 Red Toyota Rav 4.

The driver of the Honda CR-V, Pedro Lucas Jorge, age 27, of Gainesville, received no injuries from the crash. The passengers of the Honda CR-V, Magdelena Francisco Marcos, age 24, of Gainesville, Diego Lucas Francisco, age 4, of Gainesville, and Felix Lucas Francisco, age 3, of Gainesville, received no injuries from the crash. The driver of the Toyota Rav4, Sharon Simpson, age 63, of Gainesville, received no injuries from the crash.

Mr. Jorge was charged with DUI, driving while unlicensed, along with other traffic related charges.”

The report also says a warrant for misdemeanor obstruction of an officer was not approved. It was initially taken out because Jorge and Magdelena allegedly swapped seats after the collision and lied about who was actually driving the vehicle at the time of the crash.
