A called meeting of the Maysville Planning Commission which had been scheduled for Monday night to deal with controversial plans for a data center in the Jackson County town has been canceled.
In a letter to the planning board, City Clerk Kim Jackson noted that a public hearing had already been held and that the rezoning had been approved. “The Maysville Land Use Management Code does not authorize additional public hearings for zoning matters that have already been approved. Furthermore, such approvals cannot be rescinded except in cases involving gross violations of the construction and design plans submitted and approved as part of the conditional use application.”
BACKGROUND
The Planning and Zoning Board had volunteered to include an informational session regarding the proposed data center at the Maysville Industrial Park as part of its regularly scheduled meeting on May 18. The purpose of this session was to provide citizens of Maysville with information about how the facility would operate.
Attendance at the meeting greatly exceeded expectations and surpassed the legal capacity of the normal meeting room. As a result, the meeting was postponed until June 1. However, after schedules were reviewed the following day, it was determined that most city representatives would be unable to attend on the rescheduled date. Because the information intended for presentation at the May 18 informational session had already been distributed in printed form that evening, the June 1 meeting has been canceled.
The May 18 meeting was posted as an informational session only and not as a public hearing for citizens to voice concerns regarding the data center. Public hearings on this matter were conducted several months ago, prior to the City Council’s vote approving the conditional use application submitted by Northern Data.
