The lawsuit against the creation of the city of Mulberry in north Gwinnett near the Hall County line has been dismissed.
A Gwinnett County judge ruled in favor of going ahead with the creation of the city, despite arguments by opponents that the city charter violates the state constitution because it does not provide for property taxes.
The ruling means supporters can proceed with the election of the first city council in November. But appeals are promised.
