A judge from Athens has taken under advisement arguments presented in a Gainesville courtroom Tuesday at a pre-trial hearing for Hall County Sheriff Gerald Couch.
Couch, suspended from his duties by Gov. Kemp because of a DUI arrest earlier this year, is requesting that the charges against him be dismissed because they were unlawfully filed because they are traffic charges and were filed on private property.
The prosecution, however, contends they were lawful even though Couch was arrested in the driveway of his home and not on a public road.
