FLOWERY BRANCH POLICE DEPT. (FBPD) NEWS RELEASE:
“On April 14…officers with the Flowery Branch Police Department received a delayed
report of a domestic dispute and sexual assault that reportedly occurred at a local residence.
The victim reported that James Andrew Mitchell, 30, of Flowery Branch had previously
damaged property inside their home and forced her to engage in non-consensual sexual
intercourse. Investigators initiated an immediate and thorough investigation into the allegations.
Three days later investigators established probable cause to obtain an arrest warrant for Mr.
Mitchell on one count of Criminal Trespass under the Family Violence Act. Mr. Mitchell was
subsequently taken into custody during a follow-up meeting with investigators.
The investigation into the sexual assault continued.
Monday investigators established probable cause to charge Mr. Mitchell with one
count of Rape, and an arrest warrant was issued.
Tuesday Mr. Mitchell was taken into custody by the Gwinnett County Police
Department who later turned him over to Flowery Branch officers.
Mr. Mitchell was transported to the Hall County Detention Center without incident.”
