Appeals court rules against Hall tax assessors in tax appeal cases

The Hall County Board of Tax Assessors has lost an appeal to the Georgia Court of Appeals in two identical tax appeal cases. The appeals court ruled Wednesday on two superior court orders from the board, denying its motions for summary judgment.

Oliver Family Investments, LP had applied to renew conservation use covenants for two pieces of property it owns. The board denied Oliver’s applications, which Oliver appealed to the superior court. Ultimately, the superior court denied the Board’s motions, finding that “issues of fact” remain.
